Merritt Walking Sightseeing App Policy Agreement
Introduction
1. Acceptance of Terms
By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by this Policy Agreement and our Privacy Policy. This Policy Agreement applies to all users of the App, including but not limited to users who are browsers, vendors, customers, merchants, and/or contributors of content.
2. User Accounts
Registration: To use certain features of the App, you may be required to register and create an account. You must provide accurate and complete information during the registration process and keep your account information up-to-date.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. User Conduct
Prohibited Activities: You agree not to engage in any of the following activities:
- Violating any applicable laws or regulations.
- Posting or transmitting any content that is defamatory, obscene, offensive, or otherwise objectionable.
- Interfering with or disrupting the App or servers or networks connected to the App.
- Attempting to gain unauthorized access to any portion of the App or any other accounts, computer systems, or networks connected to the App.
User Content: You retain ownership of any content you submit, post, or display on or through the App. By submitting content, you grant us a non-exclusive, royalty-free, worldwide, transferable, sub-licensable license to use, reproduce, modify, create derivative works from, distribute, and display your content in connection with the App.
4. Privacy and Data Collection
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection, use, and sharing of information as described in our Privacy Policy.
Data We Collect
We collect the following types of personal information from users:
1. Email Address and Password:
- We collect your email address and password during the signup and login process. This information is used to create and manage your account within the App.
- We do not share your email or password with any third parties.
2.Location Access and Location Tracking:
- We access your device location to provide location-based services within the App.
- The App uses your location to display nearby places of interest on the in-app map and to allow users to track their current location in real time.
- This feature helps users navigate and find their desired destinations more efficiently.
3. Camera Access:
- We access your device’s camera to allow you to upload photos and videos directly within the App.
- Users can upload images and videos to enhance their experience while using the App, such as sharing trip highlights or documenting their journey.
How We Use Your Data
The collected data is used solely within the App for the following purposes:
Email and Password: To manage your account, provide login functionality, and ensure account security.
Location Access and Tracking: To provide users with accurate navigation, display places of interest, and allow users to see their current position on the map.
Camera Access: To allow users to upload photos and videos directly from their device.
We do NOT share your personal information with any third parties. All data collected is used exclusively within the App to enhance user experience.
5. Intellectual Property
Ownership: The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Merritt & Nicola Valley Destination Marketing Society, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use.

In no event shall the Merritt Walking Sightseeing App, its affiliates, licensors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the App.
- Any unauthorized access to or use of our servers and/or any personal information stored therein.
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party.
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the App, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
